Terms & Conditions
This contract sets out the terms upon which Homely Lets Services Limited (“Homely Lets”) will provide a serviced house to you as set out in the booking confirmation (the “Accommodation”). This contract is between the person who books the Accommodation (“You”) and Homely Lets.
1. Booking Confirmation
To reserve the Accommodation, Homely Lets will require 100% of the total amount due. This amount is refundable as long as more than 14 days prior to your arrival you notify us by email that you no longer require your booking.
For bookings made within 14 days of arrival, full payment, by cleared funds, is required at the time of booking. In the event of a cancellation within this period no refund will be given.
Bookings are made as follows: if booking by telephone, once Homely Lets have confirmed acceptance of your payment details; or if booking via our website or email and the requested accommodation is available, once you receive written confirmation of your booking.
Should payment not reach Homely Lets within the required time stated, Homely Lets reserves the right to cancel any booking made.
2. Method of Payment
Homely Lets accepts the following methods of payment:-
• Credit/Debit Card: Visa, MasterCard, & American Express.
• Bank Transfer: Pounds sterling. Bank details available on request.
3. Booking Extensions
If you wish to extend your stay, please let us know and we will check availability. Payment must be made immediately on invoice. Failure to do so will result in a clean being scheduled for the original day of check out (and payable by You).
4. Accommodation
You are only granted a licence to occupy the Accommodation and this agreement gives you any other rights either express or implied to the Accommodation.
5. Occupancy
The number of people permitted to occupy each Accommodation is limited to the number of beds. If the number of people permitted to occupy a property is exceeded, Homely Lets reserves the right to charge for additional guests at the rate of £200 per guest per night or to require additional guests will have to vacate the property.
6. Duty of Care/Responsibility
You, and any other persons staying at the property with You (known as “Guests”), must ensure noise levels are restricted. Reports of excess noise from neighbours to Homely Lets may result in termination of the stay. In addition, Guests have a responsibility and duty of care to ensure damage is not deliberately inflicted on the property or its contents. Smoking is prohibited and any evidence of this in the Accommodation will incur penalties to cover the cost of any damage, extra cleaning costs and property downtime. Any damages (for smoking or otherwise) will be charged to You via invoice and payable in cleared funds within 7 working days. Homely Lets also reserves the right to deduct such sums from the deposit funds.
7. Arrivals and Departures
Guests can check in to the Accommodation from 3 pm on the day of arrival. Please ensure, if you are concerned about any damage to the property on your arrival, that you take photographic timestamped evidence of this and share with us. Check out is at 11 am on the day of departure. Please note you will be charged £250.00 for checking out late. Key collection details will be provided prior to check-in date and will not be released until this contract has been signed and Your identification has been submitted.
Early Departures
In the event that a guest needs to check out prior to the agreed departure date, Homely Lets will class the departure as the end of the stay and arrange for the property to be cleaned. This will not result in any refund for the remaining nights.
8. Inventory / Property Care
All damages, over and above the deposit amount, will be paid for by the guest within 7 days of receiving the invoice from Homely Lets. Failure to do so will result in a small claims court claim being filed or other applicable legal proceedings. All interest, legal fees and any other charges related to recouping the outstanding debt will be paid for by You.
9. Additional Charges
Broadband: Broadband is available free in all property locations. Pass codes will be provided on check in. However, Homely Lets will not be responsible for any fault associated with the user’s hardware or software and no support will be available and Homely Lets will not provide compensation in any form for its failure to work.
Cleaning: Homely Lets expects the property to be left in a reasonable state on departure. If, at Homely Lets discretion, additional cleaning is required on departure, the cost of this cleaning will be an additional charge, again invoiced and payable within 7 days.
Smoking: Smoking is prohibited in the Accommodation and communal areas. In July 2007, smoking was made illegal in enclosed public areas; this includes the communal hallways as they are used by all residents and their guests. Anyone found to be smoking or if there is evidence of smoking in the Accommodation or communal areas then this will incur a £500 charge by way of Liability to cover the additional costs of cleaning, freshening and airing the Accommodation over a 24 hour period. Any damages caused will be charged for in addition to this fee, again invoiced and payable within 7 days.
Keys: Homely Lets will issue the guest with keys to access the Accommodation, accessible via lock box at the Accommodation. If the issued keys are not returned on departure we reserve the right to charge the guest or booker for the replacement of keys or changing the locks. The cost of replacement keys will be £100.00 plus VAT. The cost for replacing the locks will be no less than £100.00 plus VAT whichever Homely Lets deem the quickest way of gaining access to the Accommodation. In such event, Homely Lets also reserve the right to charge the guest for further nights stay should it be the case that we are unable to gain access to the property and re-let it.
Call Outs: If the emergency call out number is used to call out Homely Lets staff between the hours of 8 pm and 9 am for any purpose other than an emergency, Homely Lets reserve the right to charge the booker or guest a call out fee of £250 plus VAT.
10. Liability
Homely Lets cannot be held responsible in any way for loss of or damage to, contents, furniture, fittings or any personal belongings at the Accommodation. Nor is Homely Lets liable for the acts or defaults caused by third parties. You are advised to ensure your own insurance policies cover loss or damage to personal property during your stay. Guests are advised to take out adequate travel and personal insurance.
Nothing in this contract seeks to exclude liability for death and personal injury or any other liability not excludable under the laws of England and Wales.
11. Access to Properties
GUESTS FOUND CHECKING IN EARLY WITHOUT AUTHORISATION MAY BE SUBJECT TO ADDITIONAL CHARGES! PLEASE MAKE SURE YOU ARE CHECKED OUT BY 11:00am AT THE LATEST FOR CLEANING.
Check in is strictly at 3:00 pm for ALL guests.
In addition to the weekly housekeeping service, Homely Lets on occasion may need to access the property in which you are staying. Homely Lets reserve the right to gain access to all properties at all times. We will, wherever possible, endeavour to give guests as much notice as possible prior to entering the Accommodation.
12. Pets
Pets are not allowed in the Accommodation.
13. Services
Homely Lets cannot be held responsible for any failure or interruption of services to the property, including electricity and water or any damage, disruption or noise caused as a result of repair works being carried out in another part of the property or development.
14. Communication
Homely Lets operates between the hours of 9am and 8pm 7 days a week. If you are checking in after these times please call ahead during office hours to ensure you have everything you need.
15. Charges
A damage waiver will be payable in advance of your stay (see below). The lead guest takes full responsibility for any damage or additional charges and accept that they will be the named person on the invoice and the liability to pay rests solely with them. The lead guest also agrees to settle the invoice within 7 days and accepts that failure to do so will result in interest charged at 8% per day for every day that passes that the invoice is unsettled, plus any fees incurred to recover the debt. The initial damage will be deducted from the credit card held on file and you give full authorisation for this to happen whilst accepting that anything not recovered by the will be paid in full by you, the lead guest, within 7 days of the invoice being issued.
Charges incurred due to damage of the property will be as follows and the lead guest accepts full responsibility to these charges in the event of any damage found by Homely Lets:

Cost of the damage to be repaired in full.

20% administration charge to organise the repairs.

Cost of lost rental income during the nights following your stay that we are unable to rent the property out due to repairs being undertaken to remedy the damage and ensure that the Accommodation is returned to the condition that it was in at the time of your arrival.

The costs connected with the relocation costs of any guests due after your stay that cannot stay due to the damage of the property.

16. Damage Waiver
Homely Lets charge a damage waiver fee on all stays to cover you and your party up to £250 worth of accidental damage. Accidental damage is deemed as, but not limited to, stains on a couch, broken glass, door handle damaged etc. The damage waiver does not cover you and your party from malicious damage or theft and any incidents of such will be charged in full to the lead guest as per clause 15 of this agreement. The damage waiver must be paid in advance of your stay, if not the booking will be cancelled.
17. Entire Agreement
This Agreement shall be governed by the laws of England and Wales and the Parties submit to the exclusive jurisdiction of the English Courts. These terms represent the complete and exclusive agreement between the parties relating to the subject matter of the Accommodation which supersedes all previous communications, agreements or other arrangements written or oral.
No variation of this Agreement shall be effective unless in writing and signed by a duly authorised signatory of both parties.
